The Karachi Bar Association (KBA) has strongly condemned the restraint order imposed on Justice Tariq Mehmood Jahangiri, a sitting judge of the Islamabad High Court, by a Division Bench of the same court. The KBA termed the move unconstitutional and a direct assault on judicial independence and the spirit of the Constitution.
In a joint statement, KBA President Amir Nawaz Warraich and General Secretary Muhammad Ghulam Rehman Korai emphasized that under Article 209 of the Constitution, only the Supreme Judicial Council has the exclusive jurisdiction to examine the capacity, conduct, or qualification of superior court judges. Any attempt by another forum to undermine this constitutional mandate amounts to an attack on judicial independence and the dignity of the judiciary.
President Amir Nawaz Warraich warned that such actions destabilize the judiciary, shake public trust, and weaken the rule of law. He noted that no judge can perform duties independently under such uncertainty.
General Secretary Muhammad Ghulam Rehman Korai reaffirmed that the independence of the judiciary is non-negotiable and vowed that the struggle for judicial freedom and constitutional supremacy will continue. The voice of the Bar will not be silenced, he asserted.
