How country will run if state institutions stop working? Justice Mohsin

ISLAMABAD: Justice Mohsin Akhtar Kayani has remarked some particular persons have made state crippled. He remarked this is a matter of grave concern. How system will run if institutions are continued to be threatened this way.  

He observed can such statements be expected from a person who has remained Prime Minister of country. Who will stop such steps. How country will run if state institutions don’t work. 

He remarked this is not matter of a woman judge but it is matter of entire judiciary. Entire judicial system has been put at stake due to such threats. He gave these remarks while presiding over a 3 members larger bench of Islamabad High Court (IHC) during course of hearing of contempt of court case against Imran Khan. Other judges are Justice Miangul Hassan Aurangzeb and Justice Babar Sattar.  Court while issuing notice to Imran Khan has directed him to appear before it in person on August 31. Court also sought all record pertaining to speeches from PEMRA. 

Court issued orders to provide more security to additional sessions judge Zeba Chaudhry. Advocate General Islamabad told court miscellaneous petition has been submitted. If you think so then we will file.  

Court inquired during hearing of case when these controversial remarks were expressed.  AG told court controversial remarks were given in August 20 public rally. Court inquired these remarks were given in what case. AG told court judicial magistrate Zeba Chaudhry had heard Shahbaz Gill case. Judicial magistrate granted physical remand of Shahbaz Gill again to police.  Statements from office bearers of any party against institutions should be stopped.  Court inquired how anyone can give remarks in case pending hearing. Even court cannot interfere in cases under hearing.  

Justice Miangul Hassan Aurangzeb remarked it seems from way AG is giving remarks as if case has been filed by him. Justice Mohsin Akhtar Kayani remarked how system will run if courts are continued to be threatened this way. A female additional session’s judge was called by her name. This is not only matter of a female judge but it is matter of judges of entire country. If some judge gives decision against anyone then all will start making speeches against him. Where common man is being led to. You want people make decision of their cases on their own. Such statement cannot be expected from person who has remained Prime Minister of country. Entire judicial system has been put at stake due to threats to judiciary. Today there is one government. Tomorrow it will go then will it give threats. How can civil judge, magistrate or superior judiciary be targeted.  

Court inquired AG should tell will show cause notice be issued in this matter or only notice will be taken.  Justice Mohsin Akhtar Kayani remarked some people think no one can do anything to them. People will be expressing their ire on social media still. When there is your government then why you don’t stop such steps. Such matters are not only limited to Islamabad only. Civil bureaucracy and IG were also given threat. Have police not to work. Effects of such statements have to be seen as per law.
