Zubair Motiwala misused govt position as head of TDAP in KCCI elections

KARACHI: Due to Zubair Motiwala misuse of Government position as Head of TDAP, soft approach was taken by DGTO office earlier. However, on merit, the greatest blunder was not to issue separate Corporate and Associate Class members’ lists.
Zubair Motiwala and Co. was afraid that they may lose elections. The KCCI was the only major Chamber in the country which deliberately violated the law since last fifteen years, just due to over confidence and TDAP position held by Zubair Motiwala, the past President of Karachi Chamber of Commerce & Industry (KCCI), analysts said. While commenting on the DGTO Orders of declaring KCCI elections null & void they said that the order disposed of post-election complaint filed by Arshad Khurshid and others regarding irregularities in the elections of KCCI for the term 2024-26 was justified.
The KCCI, instead of complying with the directions passed by Regulator TOs through orders No.17, 34, and 54/2024 chose to file a Petition i.e. CP No. D-4398/2024 before the Sindh High Court. The CP was consciously filed a few days before the conduct of elections and it was averred that in presence of Orders No.17, 34, and 54/2024 it was not possible to conduct elections and thus annulment of the orders was sought with prayer that KCCI be allowed to conduct elections without adhering to the orders passed by Regulator TOs and that the Regulator TOs was maliciously passing all the orders above.
The CP which came up for hearing on 16-09-2024 was admitted for hearing and Sindh High Court was only pleased to order that the Regulator TOs shall not take any coercive measure against KCCI for non-compliance of the orders No.17, 34, and 54/2024 and it was observed that the Court was not inclined to allow the electoral process until the respondents were heard. The CP again came up for final hearing on 20-09-2024 whereby the SHC was pleased to dismiss the Petition vides a short order dated 20-09-2024. The Court also issued the detailed judgment in CP D-4398/2024 and upheld the orders/ directions passed by DGTO. The KCCI despite the judgment dated 20-09-2024 passed by the SHC and non-complying the DGTO orders No.17, 34, and 54, proceeded to conduct elections, albeit illegally and unlawfully, on 21-09-2024, which again did not provide any segregation/ classification of the membership classes.
